Terms & Conditions

These terms and conditions apply to the WithHim app (listed on the App Store as “Bible Plan: Focus Christian”) for iPhone, together with any related services operated by Benjamin Bartolabac (collectively, the “Application”). Benjamin Bartolabac is referred to as the “Service Provider”.

By downloading or using the Application, you agree to these Terms and Conditions and to Apple’s Licensed Application End User License Agreement (the “Apple EULA”). If these Terms conflict with the Apple EULA, these Terms apply to the extent the Apple EULA allows. Please read them carefully before using the Application.

License to use the Application

Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on Apple devices you own or control, for personal, non-commercial use. You may not copy, distribute, modify, create derivative works from, reverse engineer, decompile or disassemble the Application, except to the extent applicable law expressly permits it.

WithHim Pro and payments

  • Access to the Application’s features requires WithHim Pro, a one-time, non-recurring purchase made through Apple’s App Store. It is not a subscription and you will not be charged again for it.
  • The price is shown in the Application before you buy and may vary by country. Payment is charged to your Apple Account at confirmation of purchase. Any promotional or “original” price shown is for comparison only.
  • Pro is tied to your Apple Account. You can restore it on other devices signed in to the same Apple Account using “Restore Purchases” in the Application.
  • All payments and refunds are handled by Apple. The Service Provider cannot issue refunds directly; you can request one at reportaproblem.apple.com.
  • The Service Provider may change prices for future purchases, add features, or offer new paid options at any time. Any charges will be clearly communicated in the Application before you pay.

Bible texts

The Bible translations included in the Application (King James Version, American Standard Version, World English Bible, Reina-Valera and Ang Dating Biblia) are in the public domain. The Application’s design, code, reading plans, topic collections, devotional copy and branding are the Service Provider’s intellectual property. Background photographs and videos are used under their respective licences and remain the property of their creators.

App blocking, alarms and reminders

Session Lock relies on Apple’s Screen Time framework, and the verse alarm relies on Apple’s AlarmKit. These features depend on permissions you grant and on how iOS behaves, which the Service Provider does not control. In particular:

  • App blocking is a tool to help you focus, not a security or parental-control guarantee. iOS updates, device settings, Screen Time permissions being revoked, or other factors may cause blocking to start late, end early or not work.
  • Sessions tied to a reading keep apps blocked until you finish that reading or end the session from the Application. You are responsible for being able to reach anything you need during a session; do not block apps you may need in an emergency. Emergency calls stay available through iOS.
  • Do not rely on the verse alarm as your only alarm for anything critical, such as work, travel or medication. The Service Provider is not responsible for missed alarms or reminders.

Your content

Highlights, notes, journal entries and custom plans you create are stored only on your device and are not shared with other users or with the Service Provider. You are responsible for them, including backing up your device. If you delete the Application or lose your device without a backup, this content cannot be recovered by the Service Provider.

Not professional advice

The Application provides Scripture, reading plans and devotional content for spiritual encouragement. It is not a substitute for pastoral care, medical, psychological or other professional advice. Topic plans about subjects such as anxiety, grief or depression are not treatment. If you are in crisis, contact local emergency services or a qualified professional.

Intellectual property

The Service Provider retains all intellectual property rights in the Application, including its code, design, trademarks, names, logos and branding. Nothing in these Terms grants you any right to use the Service Provider’s trademarks, logos or branding. You agree not to remove, alter or obscure any proprietary notices displayed in or on the Application.

Acceptable use

You agree not to:

  • Use the Application in violation of any law
  • Attempt to bypass the purchase, copy or extract the Application’s source code or bundled content in bulk, or create derivative versions of the Application
  • Interfere with or disrupt the Application or the services it relies on

Your device and connection

Reading works without an internet connection. Some functions, such as purchases, restoring purchases and analytics, use a connection when one is available; your mobile network provider’s charges may apply. It is your responsibility to keep your device secure and charged. The Service Provider strongly advises against jailbreaking your device, which can compromise its security and may stop the Application, including app blocking, from working correctly.

Updates and availability

The Service Provider may update the Application from time to time, and you may need to install updates to keep using it. The Service Provider does not guarantee that the Application will always be compatible with the iOS version on your device, and may stop supporting older versions. The Service Provider may also stop offering the Application at any time. Unless you are told otherwise, when the Application is discontinued your license ends and you should stop using it.

Termination

The Service Provider may end your license if you materially breach these Terms. Where the breach can be fixed, you will be given notice and 14 days to fix it first. Your license may be ended immediately if you break the law or infringe the Service Provider’s intellectual property. When your license ends, you must stop using the Application and delete it from your devices.

Age

You must be at least 13 years old to use the Application. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms on your behalf, and purchases are subject to Apple’s Family Sharing and parental controls.

Disclaimer

To the fullest extent permitted by law, the Application is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including that it will be uninterrupted, error-free, or that app blocking, alarms or reminders will always work as expected.

Limitation of liability

To the fullest extent permitted by law, the Service Provider is not liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, loss of data, missed appointments or business interruption, even if advised of the possibility of such damages.

Nothing in these Terms limits liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded or limited under applicable law

To the fullest extent permitted by law, the Service Provider’s total liability for any claim will not exceed the amount you paid for the Application in the 12 months before the claim.

Nothing in these Terms limits any rights you have under consumer protection laws that cannot lawfully be excluded.

Indemnification

To the fullest extent permitted by law, you agree to indemnify the Service Provider against claims, losses and reasonable legal fees arising directly from your breach of these Terms or your intentional misuse of the Application. This does not apply to claims caused by the Service Provider’s own negligence, breach of these Terms or violation of law, and is limited where consumer law restricts such clauses.

Apple

These Terms are between you and the Service Provider, not Apple. Apple is not responsible for the Application or its content, has no obligation to provide maintenance or support for it, and is not responsible for any product claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Governing law

These Terms are governed by the laws of the jurisdiction in which the Service Provider is established, excluding conflict-of-law rules, except where mandatory consumer protection laws of your country provide otherwise. Nothing here limits your right to bring a claim in a court that is competent under mandatory law.

Severability and entire agreement

If any provision of these Terms is held invalid or unenforceable, it will be changed only as much as needed to make it enforceable, and the rest remain in effect. These Terms, together with the Privacy Policy and the Apple EULA, are the entire agreement between you and the Service Provider about the Application.

Changes to these Terms

These Terms may be updated from time to time. Changes will be posted on this page with a new effective date, so please review it regularly. Previous versions are available on request.
